BIRMINGHAM, Ala. ? A federal judge refused Wednesday to block key parts of a closely watched Alabama law that is considered the strictest state effort to clamp down on illegal immigration, including a measure that requires immigration checks of public school students.
U.S. District Judge Sharon Blackburn wrote in a 115-page opinion finding some parts of the law that conflict with federal statutes, but others that don't. Left standing at least temporarily are several key elements that help make the Alabama law stricter than similar laws passed in Arizona, Utah, Indiana and Georgia. Other federal judges already have blocked all or parts of those.
Alabama Gov. Robert Bentley said most of the law was still intact and the state will enforce it. He planned to work with the state attorney general's office to appeal those parts that the judge blocked. The judge's previous order blocking the entire law expires Thursday.
"With those parts that were upheld, we have the strongest immigration law in the country," he said. "I believe that all sections of our law will be upheld."
There are three separate lawsuits against the Alabama law, including the main challenge from President Barack Obama's administration. In all, Blackburn's orders temporarily blocked several parts of the law until she can issue a final ruling. Those measures would:
? Make it a crime for an illegal immigrant to solicit work.
? Make it a crime to transport or harbor an illegal immigrant.
? Allow discrimination lawsuits against companies that dismiss legal workers while hiring illegal immigrants.
? Forbid businesses from taking tax deductions for wages paid to workers who are in the country illegally.
? Bar illegal immigrants from attending public colleges.
? Bar drivers from stopping along a road to hire temporary workers.
? Make federal verification the only way in court to determine if someone is here legally.
The judge could still allow any or allow of those sections to take effect after further litigation.
Blackburn, who was appointed by Republican President George H.W. Bush, heard arguments from opponents including the Obama administration, immigrant-support groups and civil libertarians before it was supposed to take effect Sept. 1. The Justice Department contended the state law encroaches on the federal government's duty to enforce immigration law, and other opponents argued it violated basic rights to free speech and travel.
The judge Blackburn said federal law doesn't prohibit checking students or suspects pulled over by police. She also refused to stop provisions that allow police to hold suspected illegal immigrants without bond; bar state courts from enforcing contracts involving illegal immigrants; make it a felony for an illegal immigrant to do business with the state for basic things like obtaining drivers licenses; and make it a misdemeanor for an illegal resident not to have immigration papers.
Immigration became a hot issue in Alabama over the last decade as the state's Hispanic population grew by 145 percent to about 185,600. While the group still represents only about 4 percent of the population, some counties in north Alabama have large Spanish-speaking communities and schools where most of the students are Hispanic.
Alabama Republicans have long sought to clamp down on illegal immigration and passed the law earlier this year after gaining control of the Legislature for the first time since Reconstruction. Bentley signed it, saying it was vital to protect jobs of legal residents.
Agricultural leaders fear those parts of the law could cost farmers money this autumn by scaring away Hispanic workers who are vital to harvesting crops statewide.
"There are some sweet potato farmers in this state it's really going to hurt. I don't know how they're going to get their crops out," said Jeremy Calvert, a farmer in rural Bremen.
Zan Green, a tea party activist in metro Birmingham, said she was happy with the decision, saying citizens of foreign countries have benefitted for years through welfare, entitlements, education, medical care and child tax credits.
""Judge Blackburn's ruling is the beginning of removing the enormous financial burden of illegal immigration from the backs of Alabama citizens," she said in a statement.
Both supporters and critics say it is the nation's toughest partly because of the section that would require public schools to verify the citizenship status of students and report statistics to the state. Illegal immigrants wouldn't be barred attending public schools, but opponents contend the law is designed to decrease enrollment by creating a climate of fear.
In a statement on behalf of 150 United Methodist pastors who signed a letter opposing the law, Revs. Matt Lacey and R.G. Lyons said church leaders were "pleased to see some of the harsh and far-reaching elements of the law have been struck down."
"We feel that many of these elements, written by members of the State House and Senate who campaign on Christianity, are not representative of the message of Christ who welcomed the stranger despite country of origin or status," they said.

OMAHA, Neb. (AP) ? Warren Buffett is sending a clear signal that he believes Berkshire Hathaway's stock is undervalued by announcing a plan to repurchase stock for the first time since taking over the firm in 1965.
Berkshire said Monday that the company Buffett leads will repurchase its Class A and B shares anytime they are trading at less than 110 percent of book value.
Berkshire's Class A stock surged 6.9 percent, or $6,930, to $107,250 in afternoon trading after the announcement. Its more affordable Class B shares rose $5.09, or 7.7 percent, to $71.46.
Book value is a measure of a company's value that Buffett often cites because it is similar to the intrinsic value figure he calculates to determine if an investment is overpriced. At the end of June, Berkshire estimated its assets were worth $98,716 per Class A share after liabilities were deducted.
That estimate doesn't include Berkshire's $9 billion acquisition of specialty chemical maker Lubrizol that was completed earlier this month.
Stifel Nicolaus analyst Meyer Shields said the repurchase announcement came as a surprise, but investors should realize that Buffett left the terms flexible so he hasn't committed to buying back any stock.
"He's just giving himself another tool to play defense with," Shields said.
Buffett talked about repurchasing Berkshire stock once before in his 1999 annual letter, but never did buy back shares because the price improved after he talked about it being undervalued.
Buffett did not immediately respond to an interview request sent to his assistant Monday.
Last week, Berkshire's Class A shares dipped below $100,000 for the first time since January 2010 as worries about the economy weighed down the overall market.
Andy Kilpatrick, the stockbroker-author of "Of Permanent Value, the Story of Warren Buffett," said Buffett has always said he wants Berkshire stock to trade at a fair price, and this move signals that he didn't agree with the recent prices.
Berkshire didn't commit to buying a certain dollar amount of stock, but the Omaha-based company said it wouldn't repurchase stock if doing so would reduce its cash on hand below $20 billion.
But that doesn't seem to be an immediate concern because Berkshire had nearly $48 billion cash on hand at the end of June.
David Rolfe, chief investment officer at Wedgewood Partners, said he was glad to see Buffett's announcement because Berkshire is one of the biggest holdings in Wedgewood's portfolio. Rolfe said the buybacks will be a good use for some of Berkshire's cash that will benefit long-term shareholders because Buffett will only buy the stock when it's undervalued.
"This is old-school Buffett corporate stewardship, and we applaud it," Rolfe said.
Birinyi Associates' researcher Rob Leiphart said the only other company with an open-ended buyback program like this is Exxon Mobil Corp., which announced its repurchase plan in 2000.
Berkshire doesn't have a history of stock repurchases, but America's biggest companies have been increasing the amount they spend buy their own stock. Standard & Poor's Indices says companies in the S&P 500 index spent 41 percent more on stock repurchases in this year's second quarter compared to last year. Those companies spent more than $109 billion on stock buybacks in April, May and June.
Berkshire's Class A hit an all-time high of $151,650 per share in December 2007. Its Class A stock remains the most expensive stock in the U.S., but it has declined since February when it was trading above $131,000 before several major disasters generated losses for Berkshire's insurance units. Berkshire recorded $1.7 billion in insurance losses related to the March 11 earthquake and tsunami in Japan, the Feb. 22 New Zealand earthquake and flooding in Australia.
When Buffett's investment partnership first bought Berkshire stock in 1962, the shares sold for $7 and $8 apiece. At that time, Berkshire was a New England textile firm.

When people must decide between arguably equal choices, they need time to deliberate. In the case of people undergoing deep brain stimulation (DBS) for Parkinson's disease, that process sometimes doesn't kick in, leading to impulsive behavior. New research into why that happens has led scientists to a detailed explanation of how the brain devotes time to reflect on tough choices.
Michael Frank, professor of cognitive, linguistic, and psychological sciences at Brown University, studied the impulsive behavior of Parkinson's patients when he was at the University of Arizona several years ago. His goal was to model the brain's decision-making mechanics. He had begun working with Parkinson's patients because DBS, a treatment that suppresses their tremor symptoms, delivers pulses of electrical current to the subthalamic nucleus (STN), a part of the brain that Frank hypothesized had an important role in decisions. Could the STN be what slams the brakes on impulses, giving the medial prefrontal cortex (mPFC) time to think?
"We didn't have any direct evidence of that," said Frank, who is affiliated with the Brown Institute for Brain Science. "To test that theory for how areas of the brain interact to prevent you from making impulsive decisions and how that could be changed by DBS, you have to do experiments where you record brain activity in both parts of the network that we think are involved. Then you also have to manipulate the system to see how the relationship between recorded activity in one area and decision making changes as a function of stimulating the other area."
Frank and his team at Brown and Arizona did exactly that. They describe their findings in a study published online in the journal Nature Neuroscience.
The researchers' measurements from two experiments and analysis with a computer model support the theory that when the mPFC is faced with a tough decision, it recruits the STN to ward off more impulsive urges coming from the striatum, a third part of the brain. That allows it time to make its decision.
For their first experiment, the researchers designed a computerized decision-making experiment. They asked 65 healthy subjects and 14 subjects with Parkinson's disease to choose between pairs of generic line art images while their mPFC brain activity was recorded. Each image was each associated with a level of reward. Over time the subjects learned which ones carried a greater reward.
Sometimes, however, the subjects would be confronted with images of almost equal reward a relatively tough choice. That's when scalp electrodes detected elevated activity in the mPFC in certain low frequency bands. Lead author and postdoctoral scholar James Cavanagh found that when mPFC activity was larger, healthy participants and Parkinson's participants whose stimulators were off would take proportionally longer to decide. But when deep brain stimulators were turned on to alter STN function, the relationship between mPFC activity and decision making was reversed, leading to decision making that was quicker and less accurate.
The Parkinson's patients whose stimulators were on still showed the same elevated level of activity in the mPFC. The cortex wanted to deliberate, Cavanagh said, but the link to the brakes had been cut.
"Parkinson's patients on DBS had the same signals," he said. "It just didn't relate to behavior. We had knocked out the network."
In the second experiment, the researchers presented eight patients with the same decision-making game while they were on the operating table in Arizona receiving their DBS implant. The researchers used the electrode to record activity directly in the STN and found a pattern of brain activity closely associated with the patterns they observed in the mPFC.
"The STN has greater activity with greater [decision] conflict," he said. "It is responsive to the circumstances that the signals on top of the scalp are responsive to, and in highly similar frequency bands and time ranges."
A mathematical model for analyzing the measurements of accuracy and response time confirmed that the elevated neural activity and the extra time people took to decide was indeed evidence of effortful deliberation.
"It was not that they were waiting without doing anything," said graduate student Thomas Wiecki, the paper's second author. "They were slower because they were taking the time to make a more informed decision. They were processing it more thoroughly."
The results have led the researchers to think that perhaps the different brain regions communicate by virtue of these low-frequency signals. Maybe the impulsivity side effect of DBS could be mitigated if those bands could remain unhindered by the stimulator's signal. Alternatively, Wiecki said, a more sophisticated DBS system could sense that decision conflict is underway in the mPFC and either temporarily suspend its operation until the decision is made, or stimulate the STN in a more dynamic way to better mimic intact STN function.
These are not trivial ideas to foist upon DBS engineers, but by understanding the mechanics underlying the side effect and in healthy unhindered decision making the researchers say they now have a target to consider.

When people must decide between arguably equal choices, they need time to deliberate. In the case of people undergoing deep brain stimulation (DBS) for Parkinson's disease, that process sometimes doesn't kick in, leading to impulsive behavior. New research into why that happens has led scientists to a detailed explanation of how the brain devotes time to reflect on tough choices.
Michael Frank, professor of cognitive, linguistic, and psychological sciences at Brown University, studied the impulsive behavior of Parkinson's patients when he was at the University of Arizona several years ago. His goal was to model the brain's decision-making mechanics. He had begun working with Parkinson's patients because DBS, a treatment that suppresses their tremor symptoms, delivers pulses of electrical current to the subthalamic nucleus (STN), a part of the brain that Frank hypothesized had an important role in decisions. Could the STN be what slams the brakes on impulses, giving the medial prefrontal cortex (mPFC) time to think?
"We didn't have any direct evidence of that," said Frank, who is affiliated with the Brown Institute for Brain Science. "To test that theory for how areas of the brain interact to prevent you from making impulsive decisions and how that could be changed by DBS, you have to do experiments where you record brain activity in both parts of the network that we think are involved. Then you also have to manipulate the system to see how the relationship between recorded activity in one area and decision making changes as a function of stimulating the other area."
Frank and his team at Brown and Arizona did exactly that. They describe their findings in a study published online in the journal Nature Neuroscience.
The researchers' measurements from two experiments and analysis with a computer model support the theory that when the mPFC is faced with a tough decision, it recruits the STN to ward off more impulsive urges coming from the striatum, a third part of the brain. That allows it time to make its decision.
For their first experiment, the researchers designed a computerized decision-making experiment. They asked 65 healthy subjects and 14 subjects with Parkinson's disease to choose between pairs of generic line art images while their mPFC brain activity was recorded. Each image was each associated with a level of reward. Over time the subjects learned which ones carried a greater reward.
Sometimes, however, the subjects would be confronted with images of almost equal reward a relatively tough choice. That's when scalp electrodes detected elevated activity in the mPFC in certain low frequency bands. Lead author and postdoctoral scholar James Cavanagh found that when mPFC activity was larger, healthy participants and Parkinson's participants whose stimulators were off would take proportionally longer to decide. But when deep brain stimulators were turned on to alter STN function, the relationship between mPFC activity and decision making was reversed, leading to decision making that was quicker and less accurate.
The Parkinson's patients whose stimulators were on still showed the same elevated level of activity in the mPFC. The cortex wanted to deliberate, Cavanagh said, but the link to the brakes had been cut.
"Parkinson's patients on DBS had the same signals," he said. "It just didn't relate to behavior. We had knocked out the network."
In the second experiment, the researchers presented eight patients with the same decision-making game while they were on the operating table in Arizona receiving their DBS implant. The researchers used the electrode to record activity directly in the STN and found a pattern of brain activity closely associated with the patterns they observed in the mPFC.
"The STN has greater activity with greater [decision] conflict," he said. "It is responsive to the circumstances that the signals on top of the scalp are responsive to, and in highly similar frequency bands and time ranges."
A mathematical model for analyzing the measurements of accuracy and response time confirmed that the elevated neural activity and the extra time people took to decide was indeed evidence of effortful deliberation.
"It was not that they were waiting without doing anything," said graduate student Thomas Wiecki, the paper's second author. "They were slower because they were taking the time to make a more informed decision. They were processing it more thoroughly."
The results have led the researchers to think that perhaps the different brain regions communicate by virtue of these low-frequency signals. Maybe the impulsivity side effect of DBS could be mitigated if those bands could remain unhindered by the stimulator's signal. Alternatively, Wiecki said, a more sophisticated DBS system could sense that decision conflict is underway in the mPFC and either temporarily suspend its operation until the decision is made, or stimulate the STN in a more dynamic way to better mimic intact STN function.
These are not trivial ideas to foist upon DBS engineers, but by understanding the mechanics underlying the side effect and in healthy unhindered decision making the researchers say they now have a target to consider.
